I'm researching some stolen valor and possible federal fraud. Can a person endure a "dishonorable discharge" and still garner VA benefits and full military disability? There is some funky goings on with the official name too. Trying to see if there is enough to warrant an official solicitation of the DD214 with the family.

this person was convicted twice and incarcerated post "service" for various activity including forgery, fraud, larceny and aggravated assault. A 10 yr. and 12 yr. sentence. I do know a debilitating injury was sustained in a motorcycle accident. It could have been while in service, off in civilian activities. He never left the states for sure.

What's odd is a Jr. added to the name and listed in some paperwork, that is incorrect. It's quite the mystery. His son and I will have to officially solicit the DD214 as this person of interest is now deceased. His whole life seems to be a lie. Even has his name engraved in stone in a local foreign war Vietnam memorial - he never served. Pawnshop medals touted as "his". If I were a veteran it would really piss me off. The family is trying to get the true story. I'm involved.

I'm wondering if he could have snookered the VA with falsified paperwork and system. Once it's IN some supporting documents would seal the deal. He was evidentially very good at the con. Bought 10 Lincoln cars wholesale in AR with bogus checks and sold them in TX. Did get caught but pulled it off! I'm putting together pieces of the puzzle. I need to write a book.

have snookered the VA in the past. There is a person in our local Legion post that supposedly, research has shown didn't serve. Yet is on the board. I'm waiting to see what the outcome will be.

He got tens of thousands of dollars over the last 30+ years and full VA benefits, didn't pay property taxes, free DAV automobile tags, etc.

We are pretty certain he was dishonorably discharged. I'll pursue the DD214.

Working at the VA, in Chemical Dependency, and I can't tell you how many guys lied about their service time so they could get a SC Disability. Especially after they started giving out diabilies for PTSD. Sometimes Veterans are they're own worst enemy, cause when this type of thing gets out there, it gives the civilian population a bad impression of the whole system. You can always tell a combat veteran from a wannabe, cause the wannabbe'a tell stories of combat to ANYONE, and a true combat Veteran has to trust someone TOTALLY before they say anything.

Dishonorable discharge makes a veteran ineligible for all VA benefits. A character of service determination remains on your military record unless a discharge review board modifies the character. However, this board may only modify, correct, or change characters of service not imposed by a court-martial

The only way he'd be eligible for benefits would be if he somehow got his discharge upgraded. Otherwise he might possibly have gotten a copy of someone else's DD 214 with the dame or similar name. Looking back at my dealing's with the VA since 1978 all they ever asked for was a copy of my DD214. It has all the information on it they ask for, date of birth, service dates, ssn etc. I was never asked for any other form of ID. You can report suspected fraud to the VA. I have noticed that as the Vietnam Vets are aging the VA has done more fraud investigations.

It certainly is possible. We are going to continue our investigation. It’s looking more and more like the Govt. has been defrauded.

If it was imposed by court martial then it cannot be over ruled and all VA benefits are lost. If it wasn’t imposed by court martial then the VA can review it and give benefits. I don’t remember any Dishonorables given In my 21 years that weren’t the results of a court martial. Sounds like something fishy going on there!

a general court martial, usually for something very serious like rape and murder, not theft etc. The worst administrative discharge is called an “other than honorable”. Sometimes folks not familiar with withheld finer points of UCMJ conflate the two. Other, less punitive, court imposed discharge is a bad conduct discharge. Less punitive admin discharge is a general discharge. Admin discharges do get later upgraded by a review board.

When you get a dishonorable discharge you do not rate anything. Basically are a felon because you are not allowed to purchase weapons either

result of an injury while in the service and then do something to get them self a dishonorable discharge, the can still be provided VA benefits.

Not a mine in a rice patty as he told me. The big family story was a lie. He never left the states. Was up in NY I think. I'm helping my step-brother who is actually the next of kin.
