There is nothing to prevent a private company from doing so. Pretty smart of the Democrats to find a loop hole
I REALLY DON"t think that makes any sense as when we

take a person's credit card for anything, we type in the amount of the sale, then run the card thru the scanner and that's it. If it is OK'd we give them one of the sales slips and they sign it. That's it. There is never a mention of what they are buying. And it could be a tent, or a canoe, or any big ticket item and there is never a mention of what it is on the credit card sheet. The only thing ever written on it is the customer's signature. Unless the credit card companies change everything in the way the item is sold with a description of the item it seems this is a big worry about nothing.

The relevant passage is:
"The International Organization for Standardization (ISO) voted in favor of creating a merchant code for firearms stores, according to Reuters.
Merchant codes are four-digit codes that categorize retailers across all industries; until now, gun purchases had been classified under “miscellaneous retail stores” or “sporting goods stores.”
"
I suppose they will use that merchant category code and a dollar amount, and assume a purchase is for firearms.
There has to be a big law suit over this,
